These Terms of Service ("Terms") govern your use of Mekanik (mekanik.ai), an AI-powered service manual search tool operated from Montreal, Quebec, Canada. By creating an account or using our service, you agree to these Terms.

1. What Mekanik Does

Mekanik is a SaaS search tool for auto mechanics. You upload your own service manual PDFs, our AI indexes the content, and you search it using plain language. We do not provide, distribute, or host service manuals for download. We are a tool for searching documents you already own.

2. Your Account

You must be at least 18 years old to use Mekanik. You are responsible for keeping your account credentials secure and for providing accurate information when signing up. One account corresponds to one shop.

3. Subscriptions and Billing

Mekanik is offered as a subscription with monthly or yearly billing
New accounts start with a 7-day free trial
After the trial, you must subscribe to a paid plan to continue using Mekanik
All payments are processed securely through Stripe
Prices are listed on our website and may change with 30 days notice
If payment fails, we may suspend access until payment is resolved

4. Cancellation and Refunds

You may cancel your subscription at any time from your account settings.

Your access continues until the end of your current billing period
You will not be charged again after cancellation
Refunds are not provided for partial billing periods
After your billing period ends, your data will be deleted within 30 days

If you believe you were charged in error, contact [email protected] within 7 days.

5. User-Uploaded Content

You are solely responsible for the content you upload. By uploading a document, you represent that:

You own the document or have a valid license to use it (e.g., you purchased the service manual)
You will not upload copyrighted material you do not own or have the right to use
Your use of the document does not violate any law or third-party rights

We do not review, verify, or endorse uploaded content. We act solely as a tool for indexing and searching documents you provide.

6. Copyright and Intellectual Property

No redistribution: Your uploaded manuals are private to your shop and are not shared with any other user or third party
No public hosting: Uploaded content is not made publicly available or downloadable
Isolated storage: Each shop's documents are stored separately and only accessible by authorized users of that shop (including via QR code access)

If you are a copyright holder and believe content on Mekanik infringes your rights, contact [email protected] with details. We will respond to valid takedown requests promptly.

7. QR Code Access

Mekanik provides a QR code feature that allows shop technicians to access the search tool for your shop's manuals. QR code access is limited to searching -- it does not allow downloading, exporting, or viewing full documents. You are responsible for controlling who has access to your shop's QR code.

8. Acceptable Use

You agree not to:

Upload content you do not own or have a license to use
Distribute, share, or resell copyrighted materials through Mekanik
Attempt to extract, scrape, or bulk-download indexed content
Access another user's data or account
Reverse-engineer, decompile, or tamper with our software
Use the service for any illegal purpose

9. AI-Generated Responses

Mekanik's AI answers are for informational reference only. While we strive for accuracy, AI-generated responses may contain errors. Always verify critical specifications (torque values, fluid capacities, safety procedures) against the original manual page. We are not liable for any damage, injury, or loss resulting from reliance on AI-generated answers.

10. Service Availability

We aim for reliable service but do not guarantee 100% uptime. We may perform maintenance, deploy updates, or experience outages. We are not liable for losses due to service interruptions.

11. Termination

We may suspend or terminate your account if you violate these Terms, engage in abuse, or use the service in a way that harms other users or our infrastructure. You may delete your account at any time. Upon termination, your uploaded documents and data will be deleted within 30 days.

12. Disclaimer of Warranties

Mekanik is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We make no warranty regarding the accuracy, reliability, or completeness of AI-generated answers.

13. Limitation of Liability

To the maximum extent permitted by law, Mekanik and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

14. Privacy

Your use of Mekanik is also governed by our Privacy Policy. Your uploaded documents are stored securely and are not shared with third parties.

15. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada. Any disputes shall be resolved in the courts of Montreal, Quebec.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
